Terms of Service

These Terms of Service ("Terms") are an agreement between Keytone Applications, LLC ("Keytone Applications, LLC", "Company", "we", "us", or "our") and you ("you" or "your") governing your use of the Outset mobile application and any related services (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Eligibility and accounts
You must be at least 13 years old to use the Service. If you are between 13 and 18, you may only use the Service with the involvement and consent of a parent or legal guardian. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate account information and to notify us promptly of any unauthorized use of your account.
What the Service does — and its limits
Outset lets you define the weather conditions you care about for a location and sends you a notification when the forecast is expected to match. Forecast data is sourced from third-party weather data providers, including Apple WeatherKit, and is inherently uncertain and subject to change without notice. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY FORECAST, MATCH, OR NOTIFICATION. The Service is not a substitute for official weather warnings, watches, or advisories issued by government meteorological authorities (such as the U.S. National Weather Service), and you should always consult those official sources — not Outset — before making decisions that involve your safety, health, property, or the safety of others. Push notifications may also be delayed, altered, or not delivered at all due to factors outside our control, including your device settings, network conditions, and third-party push notification infrastructure.
Subscriptions and alerts
The Service is currently free to use. We may introduce paid features, plans, or subscriptions in the future; if we do, we will present their terms and pricing to you before you are charged, and those terms will supplement this Agreement. References to a "subscription" elsewhere in the Service (such as an alert's notification status) describe whether you are actively subscribed to receive notifications for that alert, not a paid plan.
Acceptable use
You agree not to: (a) use the Service for any unlawful purpose or in violation of any applicable law or regulation; (b) attempt to gain unauthorized access to the Service, other accounts, or our systems; (c) interfere with, disrupt, or overburden the Service or the infrastructure it relies on, including by scraping, automated querying, or excessive API use; (d) reverse engineer or attempt to extract the source code of the Service except as permitted by law; or (e) use the Service to transmit any harmful, unlawful, or infringing content. We may suspend or terminate your access for violating this section.
Your content
You retain ownership of the information you provide us, such as alert names, saved locations, and weather condition preferences ("your content"). You grant us a license to access, store, and process your content solely as necessary to operate and provide the Service to you (for example, to evaluate the forecast against your saved conditions and send you a notification). We are not responsible for loss of your content and recommend not relying on the Service as the sole record of any information important to you.
Third-party services
The Service relies on third-party providers to function, including forecast data providers (such as Apple WeatherKit), cloud infrastructure and messaging providers (such as Google Firebase, for authentication, data storage, and push notification delivery), and email delivery providers (such as Mailgun). These providers operate under their own terms and privacy policies. We are not responsible for the availability, accuracy, or acts or omissions of any third-party service, and outages or errors on their part may affect the Service's availability or accuracy without constituting a breach of these Terms by us. Intellectual property
The Service, including its design, text, graphics, logos, and underlying software, is owned by Keytone Applications, LLC or its licensors and is protected by intellectual property laws. These Terms do not grant you any right or license to reproduce, distribute, or create derivative works from the Service except as necessary to use it for its intended purpose.
Account deletion and termination
You may delete your account at any time from within the Service. Doing so permanently deletes your account profile, your alerts, and your notification history from our systems — this cannot be undone, and we recommend against deleting your account if you may want that information later. We may suspend or terminate your access to the Service, with or without notice, if we believe you have violated these Terms or if we discontinue the Service.
Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY FORECAST OR NOTIFICATION WILL BE ACCURATE OR DELIVERED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL Keytone Applications, LLC, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING ANY DECISION MADE OR ACTION TAKEN IN RELIANCE ON A FORECAST, MATCH, OR NOTIFICATION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) FIFTY U.S. DOLLARS ($50) OR (B) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
Indemnification
You agree to indemnify and hold harmless Keytone Applications, LLC and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, or your violation of these Terms or applicable law.
Governing law and dispute resolution
These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules. You and Keytone Applications, LLC agree to submit to the exclusive jurisdiction and venue of the state and federal courts located in Tennessee for any dispute arising out of or relating to these Terms or the Service, and you waive any right to a jury trial in such a proceeding.
Changes to these Terms
We may modify these Terms from time to time. If we make material changes, we will notify you (for example, by email or an in-app notice) before the changes take effect. Your continued use of the Service after a change becomes effective constitutes your acceptance of the revised Terms.
Severability
If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
